HIPAA Notice of Privacy Practices

1. Our Legal Duty
Existto Lifecare is required by the Health Insurance Portability and Accountability Act (HIPAA) and applicable federal and state laws to maintain the privacy of your Protected Health Information (PHI). We are obligated to provide you with this Notice of our legal duties and privacy practices respecting your medical data when utilizing our patient services, clinical interfaces, or medical medical technologies.
2. How We May Use and Disclose Your PHI
Under HIPAA regulations, we are authorized to use or disclose your Protected Health Information for the following primary purposes:
- For Treatment & Clinical Support: We may share PHI with physicians, nurses, technicians, or medical staff involved in dispensing treatment or operating our blood bag systems and pharmaceutical delivery devices.
- For Healthcare Operations: We may use PHI for assessing product safety, conducting quality assurance reviews, auditing medical technology reliability, and complying with FDA vigilance protocols.
- Business Associates: We may disclose PHI to contracted external vendors who perform administrative, data storage, or regulatory compliance functions on our behalf under enforceable HIPAA Business Associate Agreements (BAAs).
- As Required by Law & Public Health: We must disclose PHI when mandated by judicial court orders, subpoenas, FDA product recalls, public health infection notification requirements, and biomedical fraud investigations.
3. Uses Requiring Written Authorization
Any uses or disclosures of your Protected Health Information for marketing communications or any third-party sale of PHI strictly require your proactive, informed written authorization. You maintain the absolute right to revoke any prior authorization in writing at any time.
4. Your Individual HIPAA Rights
As an individual consumer or patient, you maintain explicit statutory rights regarding your health information:
Right to Inspect and Copy: You may request access to view or obtain copies of clinical records and PHI preserved in our systems.
Right to Request Amendments: If you believe medical details associated with your device usage or patient profile are incorrect, you may petition for corrections.
Right to an Accounting of Disclosures: You may obtain an itemized report detailing non-routine external transmissions of your PHI.
Right to Confidential Communications: You have the right to instruct us to communicate health-related inquiries through designated secure channels or alternate mailing addresses.
5. Questions & Complaints
If you believe your privacy rights under HIPAA have been compromised, you may register an official complaint directly with our Privacy Officer at privacy@existto.com or with the Secretary of the U.S. Department of Health and Human Services. You will never be penalized, retaliated against, or denied medical device services for submitting a legitimate compliance complaint.
